This week, Missouri Attorney General Chris Koster announced his plans to file suit against the state of California and their new law attempting to dictate out-of-state production methods for imported eggs sold in their state. raising consumers prices for egg’s nationwide.
Agri-Pulse released an article detailing Koster’s comments made during Missouri Farm Bureau’s annual meeting, “I don’t believe voters in California should be able to set agricultural policy in Missouri, so my office is preparing to sue California in federal court.”
The California law, spearheaded and backed by the Humane Society of the United States, will create a new unfunded mandate not just for California egg producers, but for any egg producer looking to sell within California’s borders. This appears to be a blatant violation of the U.S. commerce clause, which is intended to prevent a state from establishing discriminatory or protectionist trade policies that benefit their own state, while harming others.
Koster went on to say, “California’s new law goes further than just protecting chickens-it’s also intended to advantage California farmers.”
Koster isn’t the only one fighting the California law. Iowa Congressman Steve King proposed an amendment to the farm bill, called the ‘Protect Interstate Commerce Act,’ which would reintroduce the powers of the U.S. Constitution. This amendment would make null California’s attempt to nationalize egg production mandates. The only thing worse than an unfunded mandate from Washington, D.C. is an unfunded mandate from Sacramento.
In July, the King Amendment passed through the House Agriculture committee with strong bipartisan support on a vote of 33 yes and 13 no.
While many question the future of the farm bill, Koster is taking no chances with Missouri’s agricultural and economic well-being at stake. Protect the Harvest, along with the Missouri Farm Bureau, support Koster’s decision to challenge the California law.
