Attorney for Fremont says trial may be avoided

1-6-12, FREMONT, Neb. (AP) - An attorney representing Fremont in a legal fight over a city ordinance that bans hiring or renting to illegal immigrants says the case could avoid a full trial.

A combined lawsuit led by the American Civil Liberties Union and the Mexican American Legal Defense and Educational Fund is challenging the voter-approved ban as discriminatory. The case is to be heard in federal court in April.

The city's attorney, Kris Kobach, says both sides on Tuesday filed summary judgment motions, which would result in a judge ruling in the case before it goes to trial.

Kobach says it's "significant" because the case is regarded as a question of law, which makes it less likely there will be a full-fledged trial.
